Buying a Miami rental property: Airbnb rules, HOA and net returns

Buying and investing in Miami from Latin America · Part 4 of 5
A Miami rental property can combine personal enjoyment with income, but the combination needs documented rules and realistic numbers. Advertised rent is not the amount you keep after expenses. Being able to list a home on Airbnb does not establish permission to operate it.
For a buyer based in Mexico, Colombia or elsewhere, begin with two questions: what rental use does the specific unit permit, and what cash can remain after operating costs? Use the same method across properties instead of treating a projection as a promise.
Miami rental property: choose the right rental model
Annual leases, monthly stays and nightly accommodation have different management, furnishing, licensing, cost and seasonality profiles.
Buildings may limit minimum lease length, frequency, occupancy, pets or outside operators. Some require a particular management program. Request the rules, operator agreement and owner-use calendar. Marketing language should match the property documents.
Check short-term rentals at three levels
Level | Review |
Municipality and address | Zoning, permitted use and applicable local certificates and registration |
State of Florida | Lodging license where required and tax registration |
Building and unit | Declaration, rules, approvals and operating restrictions |
City of Miami, Miami Beach and Coral Gables are separate municipalities. Permission in one does not establish permission in another. City of Miami treats short-term accommodation as a lodging use subject to zoning and property requirements.
Association consent does not replace government authorization. A state lodging license does not override the building’s private restrictions. Sources: City of Miami short-term rental procedures and Florida DBPR vacation-rental condo licensing.
Understand HOA dues, insurance and assessments
Ask for current condominium dues and the services included. A price per square foot only helps if the area used in the calculation is clear. Association dues and rental-management fees are separate expenses.
Review the budget, reserves, financial statements, insurance and relevant meeting records. Ask about approved or proposed special assessments, repairs and applicable structural studies. Low monthly dues alone do not prove financial health.
Clarify what the master policy covers and what unit coverage is needed for your intended use: interiors, contents, liability, loss of rent and possible flood exposure. Deductibles also matter. DBPR’s condominium guidance explains reserves and association records.
Calculate net returns consistently
Start with rent you expect to collect. Subtract vacancy, discounts, platform and management charges, unrecovered cleaning, maintenance, dues, insurance and property tax. Then consider financing and income tax separately.
Annual net operating income divided by total acquisition investment gives an operating yield before debt and income tax. Cash-on-cash performance after debt service uses a different denominator and answers a different question. Do not compare the two as if they were identical.
Fictional annual example, without debt | Amount |
Potential rent: 4,000 USD for 12 months | 48,000 USD |
One vacant month | −4,000 USD |
Collected rent | 44,000 USD |
HOA dues | −12,000 USD |
Property tax | −10,000 USD |
Insurance | −2,500 USD |
Management: assumed 10% of collected rent | −4,400 USD |
Repairs and replacements | −2,000 USD |
Net operating income before debt and income tax | 13,100 USD |
At a fictional total acquisition investment of 730,000 USD, that is approximately 1.79%. It is not a market forecast or a development’s projected return. It illustrates how far gross rent can differ from the net result. Mortgage payments would further reduce cash flow.
Review rental taxation
Certain nonresident rental income can fall under federal gross-income taxation, while a valid election may allow net-income treatment. Deductions, depreciation, personal use and estimated payments need professional analysis.
Accommodation of six months or less can also trigger state and local lodging taxes. Applicable rates depend on the location and operation. Where a platform collects taxes, verify which ones it collects, what returns remain required and who remains responsible. Read a guaranteed-return or leaseback agreement
Identify the actual party promising payment, the term, the base used to calculate the percentage and the costs paid by each party. Confirm whether the figure is before or after association dues, insurance and taxes, and what remedies exist for nonpayment.
Review personal use, operator exclusivity, furnishing, maintenance and handover at the program’s end. Model the period afterward separately. A temporary guarantee does not establish future rental income or guarantee a profitable resale.
Frequently asked questions
Can I stay a few weeks and rent the rest of the year?
That depends on the building, operator agreement and permits. Personal use can also change expense allocation and tax treatment.
Does higher advertised rent mean a better investment?
Not necessarily. Compare net income, invested capital, debt, management workload and risk. Frequent guest turnover can introduce additional costs and vacancy.
What should I request to compare two developments?
Written rental rules, the HOA budget, insurance details, the management agreement and a transparent operating model with alternative scenarios. Distinguish documented facts from marketing assumptions.
